EVALUESERVE AND ITS AFFILIATES (DEFINED AS “EVALUESERVE”, “US”, “WE” OR “OUR”, AS APPROPRIATE) VALUE AND APPRECIATE THE TRUST YOU PLACE IN US TO PROTECT AND STORE YOUR PERSONAL INFORMATION CAREFULLY AND IN ACCORDANCE WITH APPLICABLE LAWS. THIS PRIVACY POLICY SETS OUT DETAILS OF EVALUESERVE’S INFORMATION GATHERING AND DISSEMINATION PRACTICES. IN THIS PRIVACY POLICY, REFERENCES TO “YOU”/ “YOUR” SHALL BE REFERENCES TO ANY PERSON SUBMITTING ANY DATA TO EVALUESERVE VIA ANY OF ITS PRODUCT (“PRODUCT”).

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE PRODUCT. YOUR USE OF THE PRODUCT SIGNIFIES YOUR ACCEPTANCE OF THIS PRIVACY POLICY AND YOUR AGREEMENT TO BE LEGALLY BOUND BY THE SAME. IF YOU DO NOT AGREE TO ANY OF THE TERMS OF THE PRIVACY POLICY, YOU MUST STOP ACCESSING AND USING THE PRODUCT IMMEDIATELY.

• This Privacy Policy explains how Evalueserve collects and stores information that identifies and relates to you (“personal information”) and how we use, disclose and protect such information. Evalueserve shall use your personal information only in the manner set out in this Privacy Policy. We act in accordance with applicable data protection law(s) and/or legislation(s).
• Please note that we may change, modify, add to, or delete portions of this Privacy Policy at any time at our sole discretion and without any prior notice. The date for the most recent update will appear at the top of the Privacy Policy. However, please note that it is your sole responsibility to regularly review the Product’s Privacy Policy. If you no longer accept this Privacy Policy or any changes or variations to this Privacy Policy, you must cease using the Product immediately. Your continued use of the Product is deemed as acceptance of this Privacy Policy and any changes thereto.
• Evalueserve will not sell / use / redistribute or rent your personal information for marketing purposes without your explicit consent.
• Evalueserve and its affiliates will be responsible for your personal data provided to or collected by Evalueserve for providing you the customized services.

If you are using our Product, you consent to the collection, use and sharing of your personal data as per this Privacy Policy.

Privacy Assurance

Evalueserve implements measures to protect against unauthorized access to and unlawful interception of personal information. However, no Product can fully eliminate any actual or potential security risks or threats associated with unauthorized access and/or unlawful interception of personal information.

Evalueserve and its affiliates adhere to all applicable data protection laws.

We ensure that appropriate data privacy safeguards are adopted across the organization and your rights stay the same no matter where your data is processed by Evalueserve (see Your Rights below).

How We Collect Personal Information

Direct information provided by user: We collect personal information that you provide when you use the Product offered by Evalueserve, such as when you voluntarily upload information, send us emails, and provide feedback. Examples of personal information that we collect from you are your name, address, telephone number, age, date of birth, gender, email address, password, username, or any other information that you freely supply to us.

Purpose for processing personal data

Evalueserve will process and use the personal information it has collected from you only for the lawful and legitimate purposes. These may include but not limited to processing of your personal information necessary for the performance of a contract to which you are a party, or whereby you have consented to process your information, or any legal & regulatory obligations, or for improving the security and functioning of the Product.

How We Use Your Personal Information

Your personal information may be used for:

• Facilitating your use and personalizing your experience with the Product.
• Supporting and facilitating the provision of Product that you purchase from us.
• Responding to your inquiries or fulfilling your requests for information about our Product.
• Sending you important information regarding the Product, Evalueserve’s policies and / or other administrative information related to the Product.
• Helping you address problems with the Product, including any technical problems.
• Responding to subpoenas, court orders, or judicial processes.
• Providing information to law enforcement agencies or in connection with an investigation on matters related to public safety.
• Resolving disputes and troubleshooting problems.
• Helping with any investigation or complaint.
• Providing you with relevant information or services that you request from us or which we feel may interest you based on previous interactions, where you have consented to be contacted.

How Long Do We Keep Your Personal Information?

We will keep your personal information only for as long as we are either required to by law or as is necessary for the purposes for which it was collected.

Disclosure of Your Personal Information to Third Parties

• We may disclose your personal information to our marketing agency for the purpose of running our marketing campaigns.
• Our third-party service provider may have access to your personal information, but access will be restricted only for the purposes of carrying out their services to us.
• We may share your personal information with companies that may manage and / or provide surveys and / or competitions on our behalf, some of which may be based outside the European Economic Area (“EEA”).
• We may disclose your personal information to companies within the Evalueserve group of companies if they are carrying out services related to the Product for us.
• We may disclose any information we hold about you, if necessary, in connection with any investigation or complaint in relation to the use of the Product, or to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) any person’s rights or property (including users of the Product).
• We may disclose any information to comply with any applicable law, regulation, legal process or governmental request, or for the purpose of fraud prevention or detection.

Marketing

• We would like to send you relevant and insightful information about our products and services and that of other companies in our group which may be of interest to you based on previous interactions. You may unsubscribe from receiving these at any time.
• We will not share your personal information outside the Evalueserve group of companies for marketing purposes unless you have explicitly consented.
• You have a right at any time to stop receiving marketing communications.
• If you no longer wish to be contacted for marketing purposes, please inform us.Please note, if in case you exercise the right to discontinue marketing communications from Evalueserve, by using Opt-out, or sending email to searchstream@evalueserve.com. We may retain your minimum personal information as record that you opted out and to avoid contacting you again.

Your Rights

1. Right to be informed: You are entitled to know whether we hold your personal information and the purpose your personal data is processed for.
2. Right to access: You are entitled to obtain a copy of your personal data, together with an explanation of the categories of data being processed, the purposes of such processing, and the details of third parties to whom the data may have been disclosed to.
3. Right to rectification: You are entitled to correct / update your personal information available with us.
4. Right to erasure: You are entitled to get your data erased from our customer relationship management (CRM) databases.
5. Right to data portability: You are entitled to obtain and reuse your personal data. You can either obtain the data from us or, in turn, provide it to a third party (if you so wish), or ask us to transfer your personal data directly to a third party.
6. Right to object / restrict processing or both: You have a right to object / restrict the processing / sharing of your data in some circumstances, including where the data is inaccurate (for the period during which we are verifying the data), the data is no longer required in light of the purpose of processing, or in connection with direct marketing (you can prevent / discontinue marketing communications to you by checking certain boxes on the forms we use to collect your personal data), or by utilizing opt-out mechanisms in the emails we send you.
7. Right to complain and obtain redressal: You have a right to lodge a complaint with the competent supervisory authority to obtain redressal, and, where appropriate, compensation for a breach of the applicable data protection regulation. In the above cases, we will retain minimum personal data to note that you opted out from being contacted again.

Automated Profiling and Decision Making

We may use automated profiling in limited circumstances relating to Email campaigns. As part of our Email campaigns, we will track whenever you receive, open, click a link, or share an Email you receive from us using any of our automated solutions. The automated solution profiles the information tracked to evaluate your interest towards our service offerings or promotions. This enables us to identify and target potential customers or business partner and provide you with relevant and timely content based on your interests.

Keeping Your Personal Information Accurate and Up to Date

• You can always choose not to provide personal information. However, if personal information is required, not providing it may stop you from availing parts of the services, features, or content.
• You can get access to, add to, or update your personal information at any time, and we would ask you to check that it is up to date on a regular basis. When you update the information, Evalueserve will keep a copy of the prior version where necessary for its records.

Transfer of Your Personal Information Overseas

• We may share your personal information to companies within the Evalueserve group to carry out services related to the Product and to send you marketing communications. Some of these group companies are based outside the EEA.
• We may transfer your personal information to third parties who are based outside the EEA for the purposes of providing services related to the Product, including for surveys and marketing activities.
• We will ensure that we have measures in place with these third parties to ensure that your personal information is kept secure.

Capacity

If you are using the Product as a representative of a company or other entity, you represent that you have the authority to enter into this Privacy Policy on behalf of that company or entity and agree that the terms “you” and “your” in this Privacy Policy refers to you or your company or entity.

Security Controls

We have implemented security safeguards that ensure the protection of your data, such as HTTPS. We regularly monitor our systems to mitigate possible vulnerabilities and attacks.

Sale of Evalueserve

We reserve the right to transfer information, including personal information, to a third party in the event of our sale, merger, liquidation, receivership, or transfer of all or substantially all of our assets, provided the third party agrees to adhere to the terms of this Privacy Policy and only uses your personal information for the purpose that you have provided it to us. You will be notified in the event of any such transfer and you will be afforded an opportunity to opt out.
